JamesEdition Terms of Use
1. Acceptance of Terms
These Terms of Use ("Terms") apply to all users without exception, including sellers, buyers, visitors, and any other persons accessing or using JamesEdition (collectively, "Users").
JamesEdition provides an online platform (the "Service"), and by accessing or using the Service, you confirm that you have read, understood, and agree to be legally bound by these Terms. If you do not agree, you must discontinue use immediately.
These Terms govern all content, including listings, text, images, videos, and other materials posted on JamesEdition. By using the Service, you also agree to any additional posted guidelines and policies, which may be updated from time to time.
JamesEdition reserves the right to enforce these Terms at its sole discretion. If you disagree with any modifications or are dissatisfied with JamesEdition, your only recourse is to discontinue use.
2. Amendment of the Terms
JamesEdition reserves the right to modify these Terms at any time. Changes become effective immediately upon posting. Users are responsible for reviewing these Terms regularly.
3. Role of JamesEdition
JamesEdition operates solely as a neutral online platform facilitating the visibility of real estate listings and the initiation of contact between sellers and potential buyers.
JamesEdition is not a real estate broker, agent, developer, fiduciary, or advisor, and does not participate in, control, or supervise any transaction between buyers and sellers.
Any agreement relating to the sale, purchase, rental, or other disposition of a property is concluded exclusively between the buyer and the seller. JamesEdition is not a party to such agreements and assumes no responsibility or liability arising therefrom.
4. User Roles & Responsibilities
4.1 Sellers
Sellers, including real estate agencies and developers, use JamesEdition to list properties for sale or rent. They are solely responsible for:
- Ensuring property details, pricing, and availability are accurate and up to date.
- Managing inquiries, arranging viewings, and facilitating transactions independently.
- Complying with all applicable laws, regulations, and professional obligations in their respective jurisdictions.
Sellers represent and warrant that they:
- Are duly licensed or registered where required by law.
- Hold valid professional indemnity insurance or equivalent coverage where such insurance is mandatory or customary for their profession.
- Have obtained all necessary authorizations, including the explicit consent of the property owner, to market, advertise, and offer the property via JamesEdition.
To qualify as a business seller on JamesEdition, sellers must:
- Be a registered business entity with a physical address (P.O. boxes are not accepted) or have operated as an LLC for at least 18 months.
- Maintain an operational presence in the regions where they list properties.
- Be capable of conducting property viewings for all listings.
- Have a professional company logo and appropriate branding.
Private sellers are not eligible to list properties on JamesEdition.

4.2 Visitors / Buyers
Visitors use JamesEdition to browse listings, compare options, and contact sellers.
Buyers acknowledge and agree that:
- JamesEdition does not verify the accuracy, legality, or completeness of listings.
- All due diligence, investigations, and verifications must be conducted independently and directly with the seller.
- Use of the platform is limited to persons legally capable of entering into binding agreements under applicable law.
5. Listing Policy & Content Guidelines
To maintain high standards, all listings must comply with JamesEdition's content guidelines. Sellers must ensure their listings meet the following requirements:
5.1 Price & Real Estate Property Type
- Minimum Price: Real estate listings must have a minimum asking price of $490,000 (or equivalent in local currency).
- Residential Properties Only: Commercial properties are not allowed.
5.2 Image & Media Standards
- High-Quality Images: Listings must include at least two high-resolution images (minimum 800x600 px). Blurry, pixelated, or AI-generated images are not allowed.
- Content Accuracy: Photos and videos must accurately represent the property. No overlaid text, excessive branding, or unrelated elements.
- Watermarks: Watermarks must be discreet and cover no more than 30% of the image area.
5.3 Listing Accuracy & Updates
- Listing Completeness: Properties must include correct details (size, location, number of rooms, amenities).
- Regular Updates: Sellers must review and update listings at least once every 60 days.
- Sold or Unavailable Properties: Must be removed or updated immediately.
5.4 Duplicate Listings & Compliance
- No Duplicates: The same property cannot be listed multiple times within the same account.
- Manipulative Practices Prohibited: Altering details to refresh listings, changing reference IDs, or other ranking manipulations are strictly forbidden.
- Exclusivity Rights: JamesEdition reserves the right to remove listings if another agent holds exclusive rights.
5.5 Intellectual Property & Rights to Publish
- Sellers must ensure they have full legal rights to all content submitted to JamesEdition, including but not limited to text, images, and videos.
- By submitting or uploading content, sellers grant JamesEdition a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to use, reproduce, distribute, display, publish, translate, and adapt the content in connection with the operation, promotion, and improvement of the platform and related services.
- This includes use in marketing materials, newsletters, editorial features, social media, and third-party syndication.
- Sellers represent and warrant that the content does not infringe on any third-party rights and that they have obtained any necessary permissions or licenses.

6. Contents of and Information Provided on the Website and the App
JamesEdition aggregates property listings from multiple sources to provide a global marketplace.
JamesEdition does not guarantee the availability, accuracy, or current status of any listing and does not monitor or verify transactional outcomes.
Visitors should always verify listing details directly with sellers before making purchasing decisions.
- Direct submissions - From sellers who list their properties on JamesEdition.
- CRM/MLS integrations - Properties distributed through real estate CRM or MLS systems.
- Aggregated publicly available listings - JamesEdition collects publicly available property data to enhance visibility.
6.1 Aggregated Listings & Public Data Collection
JamesEdition functions as a real estate search engine, using proprietary tools to aggregate publicly accessible property listings. Our goal is to provide the most comprehensive property information available to visitors.
- We collect and organize publicly available information to enhance property visibility.
- We do not own or claim ownership of listing content, such as property description and pictures; all rights remain with the source agency or other real estate professional.
6.2 Right to Request Removal & Agency Control
Sellers that prefer not to have their publicly available listings included on JamesEdition can request removal by contacting support@jamesedition.com. Alternatively, you can fill out a takedown request using this link:
7. Indemnification
Sellers agree to indemnify, defend, and hold harmless JamesEdition, its affiliates, directors, officers, and employees from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising out of or related to:
- The content of any listing or information provided by the seller;
- Any breach of these Terms;
- Any transaction or attempted transaction involving the seller;
- Any violation of applicable law or third-party rights.
8. Limitation of Liability
To the maximum extent permitted by applicable law, JamesEdition shall not be liable for any indirect, incidental, consequential, special, or punitive damages.
In all cases where JamesEdition may nevertheless be held liable, its total aggregate liability shall be strictly limited to the total fees actually paid by the relevant seller to JamesEdition during the twelve (12) months preceding the event giving rise to the claim.
Liability, if any, shall be limited to direct damages only.
9. Privacy & Data Protection
JamesEdition complies with GDPR and applicable data protection laws.
9.1 Data Collection & Use
- We collect basic user data (e.g., name, email, phone number) to facilitate transactions and improve services.
- Data may be used for marketing, analytics, and security. Users can manage their preferences.
9.2 User Rights & Data Requests
- Users may request data deletion, correction, or access to their stored information.
- Users can opt out of marketing communications anytime.
9.3 Security & Compliance
- JamesEdition implements security measures to protect user data.
- We comply with GDPR regulations for EU users.

10. Additional Terms
JamesEdition may modify, suspend, or discontinue any part of the Service at any time.
Accounts may be suspended or terminated for violations of these Terms.
These Terms are governed by Dutch law. Any disputes shall be subject to the exclusive jurisdiction of the competent courts of Amsterdam, the Netherlands.
